General information about the Legal Guarantee.
Each product sold by horyzon.it to a "consumer" buyer is assisted by the legal guarantee on consumer goods, which covers conformity defects that occur within 24 months from the date of delivery of the goods.
What is legal guarantee?
It is the guarantee on the sale of consumer goods provided for by Community Directive 1999/44/EC, also called the "guarantee of conformity", which protects you in the event that the products you purchase have defects of conformity with the sales contract ("Legal Guarantee").
This is the case, for example, in the case of products that work poorly, that cannot be used in the manner declared by the seller or for the purposes for which products of the same type are generally used, that do not have the characteristics or qualities promised by the seller or that do not respond to the use for which you purchased them.

What is the duration of the Legal Guarantee?
The Legal Guarantee covers conformity defects that occur within 24 months of the date of delivery of the product you purchased, even if on that date the defect was not immediately noticeable. To enforce it you must notify the seller of the presence of the defect within 2 months from when you discovered it.
Unless proven otherwise, it is assumed that conformity defects occurting within the first 6 months from the date of delivery of the goods already existed on that date, unless such a hypothesis is incompatible with the nature of the good or the nature of the lack of conformity.
We recommend that you always keep the purchase receipt found in the product packaging, as well as the confirmation documents of the shipment and delivery of the product.
Am I entitled to the Legal Guarantee?
The Legal Guarantee is rightly the sole responsibility of the consumer, that is, to those who purchase products for non-professional purposes. For example, if you purchase a laptop solely for your own personal use, you are entitled to the Legal Guarantee. On the contrary, if you purchase it to use it in your work activity, the Legal Guarantee does not apply.
Am I entitled to the Legal Guarantee on used products?
The Legal Guarantee is rightly the sole responsibility of the consumer, that is, to those who purchase products for non-professional purposes. For example, if you purchase a DVD, VHS, VINYL, CD exclusively for your personal use, you are entitled to the Legal Guarantee. On the contrary, if you purchase it to use it in your work activity, the Legal Guarantee does not apply. In the case of the sale of used product, Horyzon.it ensures that the product is functional and free of defects.
Who can I enforce the Legal Guarantee against?
If you are a consumer you can enforce the Legal Guarantee against those who have sold you the product, even if it is a subject other than the manufacturer. For products purchased by horyzon.it therefore responds horyzon.it itself. For products sold by third parties, such as on the Amazon.it Marketplace, the Legal Guarantee is borne by the seller and horyzon.it has no responsibility in this regard.
What rights does the Legal Guarantee give me?
If the product you purchased has a defect covered by the Legal Guarantee, you are entitled, without you having to incur any expense, to repair or replace the defective product by the seller. You are entitled to a price reduction or termination of the contract in the following cases: (a) if replacement or repair of the product is not possible or is excessively onerous; (b) if the seller has not repaired or replaced the product in a reasonable period of time; or (c) if the replacement or repair of the product has caused you significant inconvenience. To determine the amount of the price reduction or the amount to which you are entitled in these cases, the use you have made of the product is taken into account. Keep in mind that a minor defect for which it has not been possible or is excessively onerous to experience repair or replacement remedies does not entitle you to termination of the contract.

If it turns out that the problem stems from a lack of conformity, a file will be opened in your name and you will be assigned a code for the free repair or replacement under warranty of the defective product.
Please note that, in the event of a replacement, we will deliver the replacement product to you within a reasonable time and you will be required to return the non-compliant product to us within 30 days of the date you received our notice of dispatch of the replacement product.
